The Obama administration has quietly rewritten the rules on how it goes about designating Americans as terrorists, according to a new report by Glenn Greenwald’s Intercept online investigations project.

The report details how Obama has expanded the terrorist watch list system, “authorizing a secret process that requires neither ‘concrete facts’ nor ‘irrefutable evidence’ to designate an American or foreigner as a terrorist,” according to a key government document obtained by the Intercept.

Instead of real evidence, all the government need is the nebulous “reasonable suspicion,” which is considered one the lowest standards of proof in the American legal system. It’s less than “probable cause,” which is required to make an arrest.

Greenwald, a former investigative reporter for the U.K.-based Guardian who broke the Edward Snowden story about NSA spying on Americans, left the newspaper late last year to start the Intercept.

A 166-page document obtained by Intercept titled “March 2013 Watch listing Guidance” was issued last year by the National Counter-terrorism Center. It identifies for the first time the government’s secret rules for placing people on

its main terrorist database, as well as the no-fly list and the selectee list, which triggers enhanced screening at airports and border crossings.

The federal government shares its watch list data with local law enforcement, foreign governments and “private entities,” Intercept reported.

WND reported in 2011 that the Department of Homeland Security issued a new public service announcement encouraging Americans to look at their neighbors with a wary eye and report them to authorities if they see any suspicious behaviors.

The DHS suggests a typical woman terrorist would be a Caucasian in her late 20s or early 30s, with brunette hair, stylish clothing, high heels and a shoulder bag. A man? About the same age, short hair, wearing a shirt and slacks and familiar with technology, as he’s wearing an earpiece cellphone. Also Caucasian. This despite the fact that nearly every major act of terrorism in the United States has been carried out by non-Christians from the Middle East or North Africa.

“If you see something silly, say something: Homeland Security video portrays all ‘terrorists’ as white, middle class men,” said a headline on the counter-terrorist website Jihad Watch recently.

But the new rules, exposed by the Intercept report, allow people to be designated as representatives of terror spyingorganizations “without any evidence they are actually connected to such organizations.”  At the same time giving a single White House official the unilateral authority to place entire “categories” of people the government is tracking onto the no-fly and selectee lists.

The report also broadens the authority of government officials to “nominate” people to the watch lists based on what is vaguely described as “fragmentary information.”

Both the Obama administration, and the Bush administration before it, have resisted disclosing the criteria for placing names into the databases, even though the guidelines are unclassified.

In May, Attorney General Eric Holder even invoked the state secrets privilege to prevent watch listing guidelines from being disclosed in litigation launched by an American who was put on the no-fly list. In an affidavit, Intercept reports that Holder called them a “clear roadmap” to the government’s terrorist-tracking apparatus, adding: “The Watch listing Guidance, although unclassified, contains national security information that, if disclosed … could cause significant harm to national security.”

The document’s definition of “terrorist” activity includes actions that fall far short of bombing or hijacking. The guidelines include destruction of government property and damaging computers used by financial institutions as activities meriting placement on a list. They also define as terrorism any act that is considered “dangerous” to property and intended to influence government policy through intimidation. Whether such a broad definition could include, for example, a person taking a picture of a government building, is unclear.

Increasing the scope of what the government considers a “terrorist” can also be counterproductive, as the Intercept report pointed out.

“When resources are devoted to tracking people who are not genuine risks to national security, the actual threats get fewer resources—and might go unnoticed,” the report stated.

“If reasonable suspicion is the only standard you need to label somebody, then it’s a slippery slope we’re sliding down here, because then you can label anybody anything,” David Gomez, a former senior FBI special agent with experience running high-profile terrorism investigations, told Intercept. “Because you appear on a telephone list of somebody doesn’t make you a terrorist. That’s the kind of information that gets put in there.”

The consequences for people who end up on the U.S. government watch list can be severe.

“Once the government secretly labels you a terrorist or terrorist suspect, other institutions tend to treat you as one,” Intercept reports. “It can become difficult to get a job (or simply to stay out of jail). It can become burdensome — or impossible — to travel. And routine encounters with law enforcement can turn into ordeals.”

Oh, let’s not put Muslims on these Watch Lists, just average Americans.  The real terrorists must find this laughable as they walk over our border to plot and plan their next attack.

      You echo my thoughts too. How soon will it be before we have to carry papers and present them wherever we go to be checked? How about those microchips we hear about being put into us to track us? They already track us though so many ways. It’s frightening.

      And yes our borders are wide open to anyone coming in here. Obviously there are no adults in DC.

Then on top of it you are white, conservative, Christian, all things bad to this administration. LOL! I like how you put things about the Dictator and our lawless ATT: Gen.

      I do believe we are becoming an East Germany Security State too. Just think, some of us may not be able to cross state lines since we are “too dangerous” especially to go to DC maybe for a protest. This Gestapo can go you know what to me. Arrests and murders of us may not be too far behind.

They’ve been doing it since their existence and their pretty damn good at it. No reason for us to concentrate on muslim terrorist suspects. They so rarely commit acts of terrorism….yeah right.

    Yep pretty scary stuff. And like you said it puts most of us on their stupid watch list. We can’t profile Muslims but they can profile the rest of us Americans who are guilty of nothing other than being truly unhappy over what is happening to our country. That’s considered racism to criticize our Commander. Doesn’t take much to get on that list.

    The Muslims run free here, they can say or do whatever they want, blackmail people into shutting up about their acts, form terrorists camps, and terrorist groups but oh, no, they are guilty of nothing and on no watch list. Remember the Boston Bomber? They were on no watch list although we were warned by the Russians.

  5. Just when we think (prematurely) that he’s gone too far, he takes another couple of steps towards Hitler.

    The man is TRULY a massive danger to the longevity of our United States. If we (via the wimps in Congress) don’t throttle him back by refusing to fund his nefarious agenda, we are well and truly F’d. Never, in my wildest dreams, could I have forecast that any person could do what Obama has done – and gotten away with it.

    My current opinion is that we SHOULD NOT try impeachment, but rather cut off funds for whatever he wants to do via EOs and such. I’m afraid an impeachment, even if it were to pass in the House, would only rally his troops to turn out in November. He apparently believes that an attempt at impeachment would make him appear as a martyr and gain more support for the dem candidate in 2016 – which is likely true. Thus, that’s my reasoning for changing my tune and now being against impeachment – as much as I’d love to deflate his ego by ensuring his place in history as another failed and impeached president.

      Boy, that is so true about the move to Hitlerlization. I had my fears when he was elected and just knew he could never be impeached due to being the first black prez.

      I don’t agree with the impeachment either. First of all dingy harry would squash it immediately and the dimwit majority would never vote to indict. So what would be the use in this action. I too think it would be much more productive to cut his funds for anything unlawful he keeps doing to keep him in check. If even that can be done. He can always use illegal funds to do what he wants because what does he care about the law. We’ve seen this ad nausea before our eyes, the law breaking. He knows nothing will be done about him.

      And yes, he’d become the “great martyr” and ruin any chance of a conservative being the prez in 2016. Even though I don’t believe a conservative has a chance in 2016 anyway. The dimwits will use the “war on women” card for the 2016 race and win along with massive fraud.

      I don’t even think conservatives will win the Senate this November. The Dimwit fraud machine will be working over time besides the huge war chest each of them will have due to the constant fund raising events by the Dictator. God only knows the Dictator must keep dingy harry in charge of the Senate no matter what it takes.

  8. Chilling, great article. Who knew? I guess that was the idea. Some members of Congress had to know, but mums the word.

    Revealing: “They also define as terrorism any act that is considered “dangerous” property and intended to influence government policy through intimidation.”

    So does that mean protestors? Just abolish the 4th amendment. We’re probably all listed as selectees now, at the least. Yet he would not call Benghazi terrorism. Let me guess, the “terrorist” was the guy who made that video.

      Yeah, what exactly is the definition of “dangerous property intended to influence government policy though intimidation” mean? Does that mean like the tea party groups who got shut down by the IRS? Or Hobby Lobby taking this administration to the SCOTUS over Obamadeathcare?

      I certainly believe this means protesters too. Why, that’s intimidation don’t ya know? People standing up and out to protest must mean “influencing policy” I would think. 4th Amendment, do you mean we still have that one? LOL! Gone, gone, gone in 60 seconds is more like it.

      Oh, no, of course Benghazi was not terrorism, just an accident caused by a cheap video. Geez, how dumb do they think we are? Well, some of us are here in America, but no one who posts here or on other conservative places. But that makes us terrorists.

  9. Hi Pepper, thank for the eye opening article. The thought of being on a watch list is very concerning considering how they are defying terrorist and I agree, all of us on this blog are no doubt on their radar. We all here lashed out over everything that is wrong and we feel good about doing so. We have even at times scuffed off the possibility of being singled out by the Feds with how we would respond. The truth of the matter is this administration is proceeding with a vengeance to quell all that disagrees with their policies. It will be no small matter if it happens to one of us. This is terrible times we are living through. I commend your actions and beliefs, please keep the faith.

      Walt, there is no doubt in my mind that all of us are on the “list”. I don’t care and they won’t shut me up. They can come after me, but it won’t do them much good. I’m a small fish in the a very large pond. There are too many other voices out there. They can’t shut us all down unless they decide to throw half of America into FEMA camps or prisons, whatever.

      We have the right under the 1rst Amendment to free speech. So far I’ve seen nothing by SCOTUS to change that. He can lawlessly try to stop freedom of speech but there are way too many organizations out there who will take him to court over this. He would not win that court case.

      We are one Nation under God even though he does everything to destroy that. Eventually his machinations will no longer work. It will become clear to almost everyone that he is a dictator.

      Grouchy, yeah, the Friday the 13th series would also apply. I can think of many horror movies that fall into this group. Hitchcock is a great one and I enjoy all of his movies. Perhaps we could put this administration into the “Gaslight” category. Trying to make us feel we are crazy when they are actually the crazy ones.

      But I don’t think there are many of us that this would work on except for those “folks who still support the current imposter”.

      And those people are nuts themselves. They are deaf, dumb and blind besides being morons. I think their ulterior motive is they think once he has the rest of us shut down, they are in the clear and will be treated special. But, oh, how mistaken they are. The Dictator is loyal to no one. They will dumped by the wayside as they are merely his useful idiots and mean nothing to him other than that.

    Much of the issue seems to revolve around how the word terrorist is being defined now. Terrorist isn’t a moozlum looking to blow up infidels any longer.
